Terms of use.

The ground rules for using Earlybird, whether you're buying a home or listing one. Last updated 22 October 2026.

1. About these terms

These terms apply to your use of Earlybird (the “site”), run by [Registered company name] (company number [Company number]), registered at [Registered office address]. By using the site or creating an account you agree to them. If you don’t agree, please don’t use it.

Contact us at [hello@your-domain].

2. What Earlybird is

Earlybird is a website that helps people find and compare new build homes in the UK and connects buyers with the developers who sell them. We are not an estate agent or a developer, we don’t sell homes, and we are not a party to any sale between you and a developer.

We don’t give mortgage, tax, legal or financial advice. Speak to a qualified adviser before you buy.

3. Listings and incentives

  • Listings are compiled from public sources and from developers. They are indicative only: prices, availability, incentives and details can change, and may be out of date or wrong.
  • Incentives such as stamp duty paid, part exchange or deposit contributions come with conditions set by the developer. Figures we show, including any estimated saving, are illustrations rather than offers.
  • Always confirm everything with the developer in writing before you reserve or commit to anything.

Area information (such as sold prices, crime, schools and transport) comes from open data sources and is provided as a guide. Visit the area and check for yourself.

4. Your account

You must be 18 or over to create an account. Give us accurate information, keep your password secret, and tell us if you think someone else has used your account. You are responsible for what happens under it. You can close your account at any time by contacting us.

We may suspend or close an account that breaks these terms or is used to harm others or the site.

5. Using the site as a buyer

Using Earlybird to search and save homes is free. When you register interest or book a viewing, we pass your details to the developer so they can contact you.

You agree not to:

  • copy, scrape or republish site content in bulk, or use bots to access it;
  • submit false enquiries or use the site to send spam;
  • try to break, overload or gain unauthorised access to the site or its data.

6. Terms for developers

  • Listing is free. We review new developer accounts and developments, usually within 24–48 hours, and may decline or remove a listing at our discretion.
  • You pay for results. A fee of £100 applies for each viewing booked through Earlybird, and £500for each reservation made through Earlybird. We confirm how and when you’ll be invoiced when we approve your account. Fees are shown without VAT unless stated.
  • You must have the right to list. You confirm you own, or are authorised to market, each development you list, and that the information, photos and incentives you provide are accurate, lawful and not misleading.
  • Claiming a listing. If we have already compiled a listing for your development, you can claim it. We may ask for proof that you represent the developer.

You give us a non-exclusive licence to display the content you submit on the site while it is listed.

7. Removal requests

If you are a developer or agent and want a listing taken down, or you believe content on the site infringes your rights, tell us through the removal request form. We’ll act on valid requests promptly.

8. Our content and yours

The site’s design, code, brand and our own written content belong to us or our licensors. You may view and use the site for your own non-commercial use, but you may not copy or reuse it beyond that without our written permission. Photos and listing details belong to their respective owners.

9. Our responsibility

We provide the site “as is” and do our best to keep it available and accurate, but we can’t promise it will always be error-free or uninterrupted. We are not responsible for the actions, listings or promises of developers and agents, or for decisions you make based on information on the site.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit. Subject to that, our total liability to you in connection with the site is limited to £100, and we aren’t liable for loss of profit, opportunity or indirect loss.

If you use the site as a consumer, your statutory rights are not affected.

10. Changes and law

We may update these terms from time to time. The date at the top shows the latest version, and continuing to use the site means you accept the changes.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, except that if you live elsewhere in the UK you may also bring a claim in your local courts.
